What is a disability settlement?
A disability settlement is a large amount of money given to you by an insurance company. This large settlement is usually offered in exchange for you giving up your right to claim any further monthly benefits. The settlement is paid out usually at the end of a legal case after a lawyer takes on your case and fights to get your benefits paid.

At Bungay Law, we work very hard to get you a disability settlement. The first thing we do is take a very close look at the reasons why the insurance company is denying your case. Legally, the insurance company needs to have clear evidence you are disabled. If they do not have that evidence, we take steps to get the information they need to consider paying you out.
The most important thing we do to get you a settlement is we send the following message to the insurance company: “We are going to take you to Court if you do not pay, so you better pay or this will cost you and your lawyers a lot of money”. We convince the insurance company that taking us on and taking you on, would be a very expensive thing for them to do. In this way, the insurance company sees that it would be cheaper for them to pay you a large disability settlement instead of losing money in legal fees and Court costs.

Is the lawyer’s fee on the settlement so big that I will not get any settlement?
No, the fee we charge is modest. Our legal fee is a reasonable percentage of whatever benefits you get in a lump sum. In our experience, in most cases, you would still be left with a very large amount of money that can cover you for much of your remaining years.
Can I negotiate a settlement on my own with the disability insurance company?
Anyone can try to get a settlement on their own. However, in our experience, someone with no legal training fighting an insurance company usually does not end well. There are timelines that have to be met in order to protect your rights. For example, if you do not sue the insurance company by a specific date, you would lose your right to get any benefits. Also, in our experience, starting legal proceedings is often the only way to force the insurance company to pay out your claim. A person could do this on their own, but the legal system is very complex. Your chances of getting a large disability settlement to improve greatly if you hire an experienced disability lawyer.
Will I have to go to Court to get a disability settlement?
Most claims do not go to Court. Usually, we sue the insurance company, and there are some minor legal proceedings as part of that process, but most of this is between the lawyers. In other words, we would do some legal work for you, but in most cases, you would not have to attend Court in order to get a settlement. In 95% of cases (in our experience), we can get someone a disability settlement without going to Court.
