Insurance Company Rejecting your paperwork/application
It is common for insurance companies to routinely reject the paperwork you submit as part of your disability application. Why is this? There are various reasons for this. One of the reasons is because the forms are given to you by insurance companies often do not allow enough space for you to adequately set out all of the details of your disability. There may only be a small space on the paperwork where you can only set out very brief details about your health and disability. This is very unfair because the real story about your disability is often long and complex.
An employer often hurts your chances of getting disability insurance
In many cases, the employer hurts your chances of getting disability insurance approval. As part of most LTD applications, the employer must submit a form that supports your claim for disability insurance. Of course, not every employer is on board with that plan. Sometimes, the employer is resentful or does not believe you are disabled. In those cases, the paperwork the employer submits to the insurance company can harm your chances of getting disability insurance.
A doctor may not be helpful
In many cases, your family doctor may not be helpful in getting your disability insurance claim approved. There are many reasons for this. In many cases, a disability claim is rejected because the insurance company uses its own doctors (who usually say you can work, even if you can’t). In order to fight this, we send you an assessment with one of our own medical experts. These doctors give you a complete medical assessment and test your actual functioning. By using the results of this testing, we can prove you are disabled. Once we prove that, we show the insurance company these new medical results and we demand that your claim be approved.
Making sure your Doctor is Helpful
At Bungay Law, we try and make sure your doctor is helping your case instead of harming it. Often, doctors do not fully understand the kind of information the insurance company needs to approve your claim. Your doctor may believe you are disabled, but may fill out the forms provided incorrectly or not in a detailed enough way. To be fair to the doctor, sometimes the questions asked by the insurance company are not clear, so it is hard for the doctor to answer the questions properly.
Our experienced legal team works with your doctor to ensure that he or she is asked the right questions. We send them a request with detailed questions so the doctor fully understands the evidence that is needed for your LTD claim to be approved. The doctor gives us written answers to our legal questions, and we then submit these better answers to the insurance company.
What if your doctor is not supportive? We can help.
Sometimes, a family doctor may not be supportive of your case. This may be because the doctor is too busy, or maybe the doctor does not fully understand your health history. If you are unable to have a good relationship with your doctor, or if you cannot find a doctor, we can assist in finding you a new family doctor.

Having the right witnesses supporting your claim is a very important part of getting your LTD insurance approved. As part of your initial application process, the insurance companies do not tell you this. They do not tell you this because they do not want your claim to be approved. However, getting properly written witness statements, reviewed by a lawyer, is an essential part of making sure you get your disability insurance payment.
