Disability Claims – Appeals & Limitation Periods – Long Term Disability Benefits
Appeals:
Whenever a disability claim is denied, the insurance company usually sends a letter stating the claim is denied. The letter might also say that the file is being closed. The letter may suggest that you can appeal the decision to deny disability benefits.
What most people don’t realize is that the appeals process is internal to the insurance company. In other words, it is not legally binding. During the “appeals” process, the insurance company has the final word on your benefits. Most often, when someone appeals, the insurer maintains its original decision to deny the claim.
If you want to force the insurance company to pay disability benefits, you may have to start legal action against them in Court. In other words, you may have to sue the insurance company.
Limitation Periods:
What most people do not know is that there are time limits on how long you have to sue the insurance company. A time limit for suing is known as a limitation period. This limitation period has nothing to do with the “appeal” suggested by the insurance company in their letter. In other words, if you choose to appeal to the insurance company, instead of hiring a lawyer, you may be running out of time to get benefits. The insurance company can say “no”, and if you have not sued them in time, you will be left without any remedies.
Don’t be fooled by the word “appeal” in the letter you get from the insurance company. The best way to ensure your rights are protected is to obtain a lawyer to fight for them legally, on your behalf.

Disability Claims – “Own Occupation” & “Any Occupation”
Most disability policies are divided into two categories of payment.
- First, someone receives disability benefits during an “own occupation” period of the policy. This is usually in the first 24 months after the date of the disability. What this means is that you can get disability benefits so long as you can prove that you are disabled from doing the duties of your own occupation, i.e. the occupation you had at the time of your initial disability.
- After the end of the “own occupation” period, the policy usually then goes into the “any occupation” period. This normally commences after the first 24 months of disability. In order to keep qualifying for benefits after 24 months, most policies require proof that you are disabled from doing the duties of “any occupation”. The wording is different in many of these “any occupation” provisions, but essentially, you need to be able to prove that you are totally disabled from working in a realistic sense.
Long Term Disability Benefits:
Insurance companies usually fight against the idea of people being qualified for the “any occupation” period. This is because, if one qualifies for any occupation definition, the person may be able to continue getting long term disability benefits to age 65. Paying out LTD benefits can cost the insurance company a lot of money.
