The injured man tried to argue that he thought his case was fine because ICBC always told him his case was accepted. ICBC had even tried to settle his claim at one point. The judge felt bad for the man, but ultimately, the law said that ICBC was not obligated to tell an injured person what steps they had to take to make sure they qualified for hit and run benefits. Because the injured man did not take the right steps, his case was thrown out of court by the judge.
The importance of proper written notice
It is necessary to give ICBC written notice of the accident and its circumstances as soon as possible. If you do not give ICBC written notice as soon as possible, you may be denied coverage.
